1. Agreement to Terms
These Terms and Conditions (“Terms”) represent a binding agreement between you (the “Participant”) and EqualStart Foundation (“the Foundation,” “we,” or “our”). By engaging in our programs or services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you disagree with any of these Terms, please do not use our services.2. Foundation Mission and Services
- EqualStart Foundation is a nonprofit organization committed to providing equitable developmental opportunities to underserved children. Our services include academic support, mentorship, mental health resources, community programs, and educational events.
- These services are provided free of charge; however, the Foundation reserves the right to determine eligibility for participation based on program criteria, which may evolve as our community needs and resources change.
3. Participant Eligibility and Information Accuracy
- By applying for services, participants confirm that all information provided is accurate and up-to-date.
- We reserve the right to verify eligibility and may request additional documentation as needed.
4. Participant Conduct and Responsibilities
- Engagement: Participants and their guardians agree to engage respectfully and constructively in all Foundation activities. This includes adhering to program schedules, completing any preparatory or follow-up activities, and cooperating with Foundation staff and volunteers.
- Behavioural Standards: To maintain a positive environment, any form of disruptive, disrespectful, or inappropriate behaviour may result in immediate removal from the program. The Foundation reserves the right to deny or withdraw services from participants who fail to adhere to these standards.
- Use of Foundation Resources: All resources and materials provided by the Foundation are intended for individual use and must not be reproduced, shared, or otherwise distributed without prior written consent from the Foundation.
5. Privacy Policy
- Data Collection: We respect the privacy of all participants and are committed to protecting personal information. Data collected during service provision will be used solely for the administration, enhancement, and evaluation of our programs.
- Confidentiality: All information gathered about participants, including personal, academic, and health-related information, is handled in compliance with applicable data protection laws. For further details, refer to our Privacy Policy.
6. Newsletter and Communications

By signing up for our programs, you consent to receiving occasional communications from the Foundation, including our newsletter. We strive to keep these communications relevant and minimal, ensuring they contain updates, program information, and opportunities. 7. Disclaimers and Limitation of Liability
- General Disclaimer: While we strive to offer high-quality services, the Foundation makes no guarantees about specific outcomes or successes associated with participation in our programs. Services are offered “as is,” with no express or implied warranties of fitness for a particular purpose.
- Limit of Liability: To the fullest extent permitted by law, the Foundation and its representatives shall not be liable for any damages, injuries, or losses resulting from participation in Foundation programs, except where such losses are due to gross negligence or intentional misconduct.
8. Intellectual Property Rights
- The Foundation retains all rights to any materials, including educational content, program frameworks, and related resources made available during program activities. These materials are provided for personal use by participants only, and any unauthorized reproduction, distribution, or commercialization is strictly prohibited.
9. Termination and Modification of Services
- Termination: EqualStart Foundation reserves the right to suspend or terminate any services at its discretion, including for breaches of these Terms or changes in program focus, funding, or resource availability. In such cases, participants will be notified promptly.
- Modification of Terms: These Terms may be updated periodically to reflect changes in our policies, programs, or applicable laws. Participants will be informed of significant changes, and continued engagement with our services constitutes acceptance of the revised Terms.
10. Dispute Resolution
- Any dispute arising from these Terms or participation in our programs will first be addressed through good-faith negotiations between the Foundation and the participant. If unresolved, disputes may be subject to mediation or other alternative dispute resolution methods as mutually agreed upon.
- This Agreement shall be governed by Canadian law. Any legal actions related to this Agreement must be filed within one (1) year after the cause of action arises.
11. Miscellaneous Provisions
- Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in effect.
- Entire Agreement: These Terms represent the entire agreement between you and the Foundation concerning your use of our services and supersede any prior or contemporaneous communications.
